LEMON LAW

What is popularly referred to as the California “Lemon Law”, is officially known as the Song-Beverly Consumer Warranty Act and is located in the California Civil Code beginning with Section 1790. It was enacted to provide protection for California consumers purchasing or leasing either new vehicles or used vehicles whose warranties are still valid. The law requires the manufacturer of the vehicle and/or its authorized representative to either repurchase or substitute the vehicle and the manufacturer is also monetarily responsible for the buyer’s attorney’s fees, licenses, registration and other associated fees that the buyer may have incurred. The following is a summary of the “Lemon Law” vehicle qualifications.

  • Warranty Rights. The vehicle must have problems covered by the warranty. However, there is a simple rule. If your vehicle is out of warranty, you do not have a “Lemon Law” claim. The vehicle must still be covered by either the original manufacturer warranty or be a “certified” vehicle whose warranty is extended by the manufacturer. If your vehicle is out of warranty but the problem was reported to the authorized dealer during the warranty time period and/or an authorized dealer attempted to repair the same problem during the period of the warranty, a valid “Lemon Law” claim may exist. Most automobile warranties extend for periods of 2 to 5 years from the date of the purchase and you are covered if the problem develops within your stated manufacturer’s warranty period (and not for only 18 months and/or 18,000 miles which is a common misconception).
  • Reasonable Number of Attempts to Repair. The authorized dealer must be unable to repair the vehicles warranty problems after a reasonable number of repair attempts . What constitutes a reasonable number depends on how serious the nature of the warranty problem. Repairs involving safety issues such as a problem with the brakes or sudden acceleration, would require fewer attempts. However, a persistent and annoying electrical problem or another non- safety issue may require at least four attempts before the manufacturer will agree to a repurchase or substitute.
  • Unreasonable Number of Days Spent in Repair. Your vehicle may also qualify for a repurchase if it spends an unreasonable amount of time at the authorized dealer. If you are having multiple warranty related issues that require continuous repair work and the automobile is out-of-service for 30 days or more at the authorized dealer during the warranty period, you may be entitled to a repurchase or a substitute vehicle.
  • Substantial Impairment to a Reasonable Person. The vehicle must incur a problem covered under the warranty that substantially impairs the vehicle’s use, value or safety to a reasonable person in the same position as the consumer. The “Lemon Law” in California, usually, will not apply to vehicles with trivial or minor defects. Each case must be judged on its own set of merits and facts, taking into account the specific needs and expectations of the each vehicle’s owner/lessee.

Additionally, even if your claim does not qualify for a repurchase or a substitute vehicle, you may still be entitled to a monetary settlement for the inconvenience and/or fees and expenses you may have accumulated while your vehicle was in a state of extended disrepair.
